Genetic patents in plant biotechnology
The objective of this paper is to study the evolution of patents with plant genetic sequences in the European Patent Office. For the purposes of this study, we have created a new database by linking information on patents containing genetic sequences from GENBANK to the European Patent Office (EPO) Worldwide Patent Statistics Database, PATSTAT. The paper, will examine the relationship between various variables and patent value. This will be complemented by a qualitative analysis of the patent abstracts. In doing so the paper sheds more light on the factors that influence patenting in this field. It also explores the dynamics of concentration in the European plant seed sector, by focusing on the top five companies controlling 64 % of all plant gene sequence patents in EPO corresponding with over 90 % of the sequences for which a patent application has been made
